TIMELINE

  • January 5, 2012 Cara, Peggy and Dean travel to Baja to meet Alex and see the property.
  • January 31, 2013 Cara wires an initial $50K payment for the property to Alex Matijas. 
  • February 26, 2013 Construction budget is finalized and construction payment schedule is established.
  • February 26, 2013 Cara emails her concern about not having a fideicomiso in place before sending the 1st payment. Alex claims that he has already paid $50k from his pocket for permits and materials and does not want to delay construction.  Alex promises to move forward with setting up the fideicomiso as construction begins.
  • February 26, 2013  Alex emails Cara account information for the initial construction payment of $240K. The account is in Juan Matijas’s name (Alex’s brother ). When Cara questioned the account name Alex claimed that he had a separate account that was already setup to keep the accounting for our house projects so it would not be confused with his personal money.
  • March 1, 2013 Cara wires initial construction payment. 
  • June 12-16, 2013 Cara flies to Cabo to check on the progress of the house. Very little progress has been made. Alex suggest delays because of weather, and that a carpenter had fallen and was injured, and that another carpenter had to be fired because he was a drug addict.
  • July 27, 2013 Alex assures Cara that construction is going well on the house, despite weather delays.
  • August 1, 2013 Cara send last payment totaling over $516,000. 
  • Nov 26 – Dec 02, 2013  Cara, Peggy and Dean fly to Cabo to check on the house. Alex behaves very strangely… avoids the Singletons. Alex tells Cara and Peggy that he has run out of money to finish the house. The Singleton’s are all suspicious at this point; however, they all dismiss the idea that they have been swindled because of their close friendship. Cara’s house is functioning as storage and housing the workers.
  • January 1st, 2014 Cara sends email requesting information on when the house will be finished and how much in overages, if any, they should expect?
  • January 2, 2014 Alex sends Cara an email saying an additional $265K is needed to finish the house.
  • January 2, 2014  Cara calls Peyton and Associates to get their professional opinion.
  • January 8, 2014  Cara flies to Cabo to meet with Alex to discuss the houses. No work had been done since October 2013. Alex’s workers are living in Cara’s house.  Cara stays in trailer on her property and works alone for 3 days unpacking the furniture shipment that she sent in November 23, 2013.  Alex is not there as was initially planned. 
  • January 16, 2014  Title search at the Public Registry reveals that the lot Alex sold Cara was in the name  John Joseph Moreno Rutowski. Title says Mr. Moreno purchased the lot for approx. $9000 in 2007.
  • February 6, 2014  Peyton and Associates send engineers to do a construction evaluation.The house appraisal is valued at $76,000. Alex charged a total of $781,936 at this point.
  • February 27, 2014  Peyton and Associates meet with John Joseph Moreno Rutowski. John Moreno claimed to know nothing about the project.

LPZ/214/AMP9/2014 Formal complaint against Mr. Moreno, Mr. Matijas et al., for fraud related to the deception used by the aforementioned to receive payments for the sale of real property and improvements. October 4, 2015 evidence resulting from Civil case Exp. 454/2014, 211/2014 was coordinated between the Second Civil court in La Paz and the authorities with the district attorney’s office in La Paz.
  • April 30, 2014 An Agreement was issued by Public Prosecutor’s Office (Ministerio Público).
  • June 1, 2014 Jose Luis Garcia Aguilar appeared before Public Prosecutor’s Office (Ministerio Público), stating that he filed Medios Preparatorios before First and Second Civil Courts.
  • June 27, 2014 Public Prosecutor’s Office (Ministerio Público) ordered to issue notifications to First and Second Civil Courts, requesting them to exhibit the records of Medios Preparatorios.

  • June 1, 2015 Evaristo and Esteban appeared before court. Both reserve their right to testify.
  • June 29, 2015 the suspects filed their written testimony.

  • July 3, 2015 the suspects Esteban Alonso Argundez Carrillo and Evaristo Luna appeared before Public Prosecutor’s Office (Ministerio Público) and confirm their testimony.
  • September 28, 2015 a notification was issued to Director General de Profesiones of SEP, requesting information about Alex Martin Matijas.
  • October 2, 2015 Attorney Pavel Castro appeared before court to remedy the extension of the complaint.
